Terms of service
1. Scope of Application Contracts, offers, deliveries, and services provided by Alpdrinks GmbH, Hans-Berchtold-Straße 52, 6840 Götzis (hereinafter referred to as "Alpdrinks") are governed exclusively by these General Terms and Conditions. Deviating conditions of the customer are not recognized by Alpdrinks unless Alpdrinks has expressly agreed to their validity in writing. By placing an order and checking the designated box, these terms are deemed accepted. These General Terms and Conditions may be amended at any time. The version current at the time the order is received shall apply.
2. Conclusion of Contract All our offers are non-binding and subject to change. This provision applies to all information in price lists, advertisements, mailings of any kind, as well as verbal information and promises, subject to typographical errors. A contract between Alpdrinks and a customer is concluded by the customer placing an order and Alpdrinks accepting it. The customer's order is submitted by sending the fully completed order form provided by Alpdrinks on the website. Alpdrinks accepts the order by sending an order confirmation via email to the customer. In the event of typographical, spelling, or factual errors on the website, Alpdrinks is not obligated to accept the offer or execute the order.
3. Delivery Delivery takes place upon receipt of payment. After sending your order, you will automatically receive an email confirmation. Alpdrinks will then process your order and send a proforma invoice for the requested items including applicable shipping costs to the email address provided. Your goods will be dispatched after receipt of payment (stating the proforma invoice number in the reference field). The original invoice will be enclosed with the goods. Unless otherwise agreed, delivery is made from stock to the address specified by the customer. We reserve the right to make partial deliveries. Unfortunately, we cannot influence any delivery delays caused by the parcel courier. Should the ordered goods be unavailable, we will inform you immediately. In this case, we reserve the right to withdraw from the contract and not deliver the ordered goods due to unavailability. All deliveries are shipped by Alpdrinks via DPD, GLS, DHL, or Austrian Post. Customers are requested to ensure upon receipt that packages are neither opened, damaged, nor manipulated in any other form. If this is nevertheless the case, customers are asked to record this in writing on the driver's delivery report or with the responsible postal carrier, as Alpdrinks cannot otherwise accept claims regarding missing goods.
4. Prices All prices listed are gross prices in Euros and include all Austrian taxes and duties. Shipping costs are not included. These are specified on the "Shipping" page and are invoiced and shown separately. The list prices applicable on the day the order is received by Alpdrinks shall apply. Prices for follow-up orders are non-binding.
5. Terms of Payment The purchase price is due in advance (advance payment). Payments are generally made against invoice – stating the proforma invoice number in the reference field – which is sent in advance by Alpdrinks to the email address provided during the order. These invoices are payable net without deductions (cash discount).
6. Retention of Title All goods remain the property of Alpdrinks until full payment has been received from the customer.
7. Right of Withdrawal If the customer is a consumer within the meaning of the Consumer Protection Act (KSchG), they have the right to withdraw from the contract within 14 calendar days of delivery of the goods. Notice of withdrawal must be submitted to Alpdrinks in writing. Return shipping costs shall be borne by the customer. Goods must be returned in resalable, unused condition. For goods that show signs of wear or whose packaging is damaged, Alpdrinks reserves the right to charge an appropriate fee for loss in value.
8. Return of Defective Goods In the case of justified defects, goods can be returned to Alpdrinks within the statutory warranty period. The customer will receive a credit note in the amount of the invoice paid. Proof of purchase (invoice) must be presented.
9. Protection of Minors For goods subject to minor protection regulations, Alpdrinks only enters into contractual relationships with persons who have reached the statutory minimum age. To comply with statutory regulations, Alpdrinks is entitled to hand over goods only upon verification of an official photo ID. In the event of a justified refusal of delivery, the customer is obliged to reimburse the actual damages incurred (e.g., delivery costs). By placing an order, the customer confirms that they have reached the statutory minimum age and that their personal details are correct. The customer must ensure that only they or an adult authorized by them to accept the delivery receive the goods.
10. Data Protection Personal data required for processing the contract is provided by the customer. Data necessary for transaction processing is stored and, if necessary, passed on to third parties within the scope of proper order processing. Data processing is carried out in accordance with statutory data protection provisions. All personal data is treated confidentially. We guarantee high security standards and commit to protecting customer data against unauthorized access. We exchange data for credit assessments, credit monitoring, and marketing purposes while respecting all legally protected interests.
11. Place of Jurisdiction Place of performance and place of jurisdiction is Feldkirch.
12. Final Provisions Should one or more provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. Invalid provisions shall be replaced by the relevant statutory regulations. This contract is governed exclusively by Austrian law.
